The People, pursuant to section 16-12-102(1), 8A C.R.S. (1986), appeal from the district courts dismissal of a felony-theft charge to which the defendant, Fred L. Afentul, pled guilty and was placed on deferred sentencing but was financially unable to make full restitution to the theft-victims during the period of deferred sentencing. We affirm the judgment of dismissal.
